Advertising on the squaremetres website - Terms & Conditions
Throughout these terms and conditions, the terms: “we”/”our” refers to Square Metres; "our website" refers to any website owned by Square Metres; and “the advertiser”, “you” and “your” refers to customers purchasing a property rental advertisement on the "square-metres.co.uk" website.
Our terms and conditions constitute a legally binding agreement and, by using or accessing our website, you acknowledge your compliance.
Content of Advertisements
Square Metres makes no representation as to the accuracy of the information contained within our website. We accept advertisements in good faith and the content is the sole responsibility of the advertiser. All advertisements must comply with relevant UK legislation including:
- the Trade Descriptions Act 1968 (which relates to false descriptions)
- the Consumer Protection Act 1987 (which relates to misleading prices)
By purchasing an advertisement for a rental property on our website, you warrant that :
- you are:
- the legal owner of the property, or
- in possession of the full consent of any co-owners to advertise and let the property, or
- you have a contract and/or written permission to let the property on behalf of the legal property owner(s).
- to the best of your knowledge, all descriptions and information supplied by you to appear on our website are honest, accurate, fair and not misleading in any way. You are responsible for the accuracy of the information supplied and you agree to indemnify us against any legal claims or other expenses that arise as a result of misleading or inaccurate claims you make about the property in the advertisement.
We expect you to provide an accurate description of the property. Property descriptions should only include facts that can be verified either by reasonable inspection; and/or confirmed and/or supported by documentation.
We undertake to take every care to faithfully reproduce the text, photographs/images and prices relating to your advertisement and provided by you to us . However, should there be any error or omission on our part, we will not be held liable for any loss that may arise as a consequence.
We reserve the right to edit or delete any descriptions which we believe to be inaccurate, misleading or fanciful. We also reserve the right to determine the design and layout of the advertisement and at our discretion, should we consider it necessary, make any alterations to submitted text or photographs. Our decision is final where there is a dispute regarding the content of an advertisement and we will not be held liable for any loss arising out of such alterations.
All materials, images, photographs, plans, etc provided by you to us for the preparation of advertisements will be treated with the utmost care, but we cannot be held liable for any loss or damage however caused.
Use of this website
Your use of our website is conditional upon your agreement that you will not use our website for any purpose that is: unlawful; prohibited by regulations; or precluded by these terms and conditions. Your continued use of our website signifies your indemnification of Square Metres from any loss, damage or costs incurred resulting from any breach of these terms and conditions, or any other legal obligation resulting from your use or conduct on our website.
Privacy
We are registered under the Data Protection Act 1998. We respect the privacy of all our website users and treat personal information with confidentiality. We do not share, sell or rent any website user's personal information and take all reasonable measures to ensure that it is securely stored.
We use "cookies" to allow us to personalise your visits to our website and improve our website's functionality. The functionality of our website, and many others, will be reduced if you disable cookies.
Copyright
The copyright for the material contained in our website belongs to us exclusively and in perpetuity, unless otherwise indicated. Our website is available for anyone to view and print hard copies of material on it for personal, non-commercial use. All other forms of copying, whether electronic, hard copy or any other format, is prohibited. All other rights in respect of copying, broadcasting or onward publication are reserved.
It is your responsibility to ensure that you have the right to reproduce any photograph, plan or digital image which you supply to us. Your submission of any image, photograph, plan, etc, for publication with your property advertisement is taken as an acknowledgement that you are the copyright owner, or you have the full consent from the copyright owner for distribution for onward publication. You hereby agree to indemnify us should any copyright infringement claim arise that relates to any material, image, photograph, etc for onward publication that you have provided to us and for which you do not own the copyright.
All digital images produced by us from material, images, photographs, plans, etc supplied by you are the property of Square Metres, and as a result they shall not be reproduced without our permission. By supplying material, images, photographs, plans etc, you grant us royalty-free licence to use them for marketing purposes including promotions and public relations.
Email Enquiries
We monitor email enquiries and will suppress any such emails that we consider not to be genuine enquiries or which are constituted to be unsolicited commercial marketing.
Advertising Costs
- Promotion codes offering discounted advertising costs are subject to limited time periods. On expiration of a Promotion code it is at the discretion of the directors of Square Metres whether or not a substitute or alternative discount is offered.
- Any discount applied to multiple advertisements only applies when more than one advertisement is purchased at the same time unless other arrangements have been agreed in writing.
- Professional discounts are subject to individual agreements.
- We reserve the right to amend or change the cost of advertisements at any time and without notice. Any changes in the cost of placing an advertisement on our website will only apply to new listings - advertisements already appearing on our website or confirmed by us will not be affected.
Payment
Advertisers undertake to make payment to Square Metres on the same day that they create their property advertisement.
We accept the following methods of payment:
- on-line payment through Google Checkout;
- BACs transfer
- cheques
Euro cheques should be sent on the same day as the advert is created to: Apt 442, 2500 - Caldas da Rainha, Portugal.
Sterling cheques should be sent on the same day that the advert is created to: Square Metres, West Mill Farm, Sturminster Newton, Dorset, DT10 2RU, England
Cheque payment is subject to a cheque handling fee itemised in the Checkout section of our website. This fee is not refundable and will apply once an advertisement has been booked even if the advertisement is subsequently cancelled or withdrawn.
Advertisements will not appear on our website until full payment has been received.
Responding to Enquiries
To uphold the integrity our website, we require advertisers to respond to all enquiries as quickly as possible and make contingency plans in the event that you are unavailable. We reserve the right to withdraw or suspend advertisements should we receive complaints that there has been no response for more than seven days.
Refusal, Cancellations, Termination or Withdrawal of Advertisements
Refusal: We reserve the absolute right to refuse to accept any submitted advertisement . The cost of the advertisement will be returned using the same method as the original payment was made.
In order to maintain the integrity of our website and to ensure that all adverts comply with pertinent UK legislation, we check all submitted adverts and will advise you of any changes that may need to be made. Any advertiser failing to amend their advert appropriately will have their advert refused and in these circumstances a refund will not be issued.
Cancellation: You may cancel your purchase of an advertisement, for any reason, within 2 working days of receiving our confirmation of your order. The cancellation request must be in writing (letter or email), and on receipt of the request, we will initiate a full refund of all advertising moneys - however, please note that the cheque handling fee is non-refundable.
Termination: We reserve the right to remove an advertisement from our website, without notice, if we receive a complaint about it's accuracy that is, in our opinion, reasonably substantiated. Our decision will be final and we will not issue a refund.
Withdrawal: Withdrawals of advertisements on our website can be made at any time provided notification is made in writing (letter or e-mail).
There are no circumstances under which we will pay any compensation for any loss howsoever incurred, including the time/cost involved in submitting the advertisement, re-advertising costs, etc.
Advertisements on our website are only permitted to pertain to one property. We reserve the right to refuse, terminate or withdraw any advertisement that includes more than one property, even if they are located on the same site, without notice or refund.
We reserve the right to refuse, terminate or withdraw any advertisement with links to external websites that are not the advertiser's personal property website or any other website that has been pre-approved by Square Metres.
Refunds
Subject to the discretion of Square Metres, following the 2 working day cancellation period, we will not make a refund after publication of paid advertising.
All refunds will be initiated within 5 working days of receipt of moneys and payments will be returned using the same method that you used when paying for the advertisement, ie:
- on-line payments - a full refund will be made via the on-line refund system
- by BACs transfer - a return transfer will be made
- by cheque - the cheque will be returned by post
This does not affect your statutory rights as a consumer.
Liability
We cannot be held liable to you, whether for misrepresentation, negligence, breach of contract, or otherwise for any direct, indirect or consequential loss or damage (including without limitation, goodwill, business opportunity, loss of profit or anticipated savings), howsoever incurred in connection with advertising on our website or suffered by you as a result of your use of our website, or any other website linked through to or from our website, or any information, materials, software or services provided on or through the provision of our website or any computer virus transmitted through our website.
Level of Service/No Warranty
The number of new advertisements that we receive at any time is beyond our control and we are, therefore, unable to guarantee response times. However, we endeavour to approve new advertisements, or changes to existing advertisements, as quickly as possible
As far as is practical, we will endeavour to ensure that the website is available on the internet at all times. However we do not guarantee uninterrupted, continuous or secure access to our services as factors outside our control may interfere with the operation of our website.
We are unable to guarantee 100% availability of our website as some breaks in service are inevitable and these interruptions are often beyond our control.
To the extent permissible by law, our services and our website are provided “as is” and “as and when” available. Whether implied by statute or otherwise, we exclude all implied conditions, warranties or other terms, including, without limitation, any terms as to timeliness of performance or care and skill.
Changes to the Website
We reserve the right to change, suspend or discontinue any aspect of our website including the availability of any website content, features or database at any time where we have a commercial, technical or legal reason to do so.
Transactions with Website Browsers
We cannot enter into any contract or any transaction concerning any property advertised on our website.
Third Party Rights
Under the Contracts (Rights of Third Parties) Act 1999, a person who is not the advertiser has no right to enforce any term of these terms and conditions however this does not affect any right or remedy of a third party specified in these terms and conditions or which exists or is available apart from that Act.
Jurisdiction
Any matter relating to our website, and these Terms and Conditions, shall be governed by English law and the English courts shall have non-exclusive jurisdiction in respect of them.
